I. Target Applicants
(I) Basic Requirements for Employers
1. The employer must be legally established, have a physical business premise, pay taxes and social insurance in accordance with the law, and have no record of serious law violations or dishonesty. The position offered to the foreign national must be of special need, with no suitable local candidates available temporarily, and must comply with relevant national regulations. The wage and salary paid to the foreign employee must not be lower than the local minimum wage and salary standard.
2. The reporting entity shall be a relevant entity within the same system.
3. If laws or regulations require prior approval by the competent industry authority, the employer shall obtain such approval.
(II) Basic Requirements for Applicants
1. The applicant shall be legally working within the Yangtze River Delta region and hold a valid Foreigner’s Work Permit in the People’s Republic of China and work-type residence permit.
2. If laws or regulations specify other conditions for foreigners working in China, such provisions shall apply.
II. Legal Basis
Notice of the General Office of the Ministry of Human Resources and Social Security on Issuing the Pilot Program for Facilitating Foreigner's Work Permit Application (R.S.T.F. [2024] No. 29).
III. Requirements for Submission of Documents
1. All non-Chinese supporting documents must be accompanied by a Chinese translation stamped with the employer's official seal.
2. Required documents shall be stamped with the employer's official seal.
IV. Application Procedure
1. Enterprises in Shanghai shall log in to the Shanghai Foreigner's Work in China Services System (https://kjgl.stcsm.sh.gov.cn/fwps/stcsm/login/loginX.jsp), enter the organization code, name, and mobile phone number for verification login. After successful login, select the authorized representative and mobile phone number for verification. Once verified, proceed to the next steps in the system.
2. The authorized representative of the enterprise shall enter the enterprise application page, click on "Cross-Regional Mobility within the Yangtze River Delta Region", and submit the application based on the applicant's specific mobility situation.
3. After the application is submitted online by the employer, it shall be subject to preliminary review (acceptance) and final review. Upon approval, cross-regional mobility may be carried out in accordance with relevant regulations.
V. Required Documents
1. Registration Form for Cross-Regional Mobility of Foreigners within the Yangtze River Delta Region in the Same System: To be completed and printed online. The applicant must sign the form, which must then be stamped with the employer's official seal or the seal of the authorized department within the employer's organization, and uploaded to the system.
2. Employment Contract or Appointment Certificate: A Chinese version of the contract shall be provided. It must be signed by the applicant and affixed with the official seal of the employer. No alterations are allowed. The employment contract or appointment certificate (including assignment letters from multinational corporations) must include essential details such as the workplace, job duties, salary, duration of work in China, position, and the signature/seal page. An appointment certificate applies to personnel performing duties under intergovernmental or international organization agreements, chief representatives and representatives of various representative offices in China, and foreign contractual service providers. Assignment letters apply to cases where a multinational corporation headquarters or regional headquarters dispatches senior executives including managers or professional technical personnel from overseas to work at subsidiaries or branch offices in China. Such letters must be issued by the headquarters or regional headquarters of the multinational corporation. If the appointment certificate (including assignment letter) lacks any of the required information, a supplementary certificate shall be provided separately. For cases where a multinational corporation's regional headquarters in China dispatches senior executives including managers or professional technical personnel to subsidiaries or branch offices in China, both the assignment letter and the employment contract signed with the regional headquarters in China shall be submitted.
3. Explanation or supporting documents regarding the cross-regional mobility issued by both the original and new employers.
4. Applicant's Valid Work-Type Residence Permit: Information page of the residence permit.
5. Other Documents: Additional documents as required by the acceptance or decision-making authority based on specific needs.
VI. Important Notes
1. Cross-regional mobility of foreigners within the Yangtze River Delta region requires consent from both the original employer and the new employer, and both parties must file records with the foreigner work management departments in the respective regions. Reapplication for the Foreigner’s Work Permit in the People’s Republic of China is not required.
2. The validity period of the applicant's Foreigner’s Work Permit in the People’s Republic of China shall be calculated based on the original validity period. Procedures such as extension and cancellation must still be handled at the original permit approval location
3. For applicants involving salary commitment matters, relevant supporting documents must be submitted in accordance with the original salary commitment when applying for extension or cancellation of the Foreigner’s Work Permit in the People’s Republic of China.
4. For cross-regional mobility filings of foreign employees hired by entities within the same system in the Yangtze River Delta region, the entire filing process is conducted online, and there is no need to submit application materials in person.
