I. Target Applicants
(I) Basic Requirements for Employers
1. The employer must be legally established, have a physical business premise, pay taxes and social insurance in accordance with the law, and have no record of serious law violations or dishonesty. The position offered to the foreign national must be of special need, with no suitable local candidates available temporarily, and must comply with relevant national regulations. The wage and salary paid to the foreign employee must not be lower than the local minimum wage and salary standard.
2. If laws or regulations require prior approval by the competent industry authority, the employer shall obtain such approval.
(II) Basic Requirements for Applicants
1. The applicant shall be at least 18 years old, in good health and with no criminal record, have a confirmed employer in China, and possess the professional skills or corresponding level of knowledge necessary for the job.
2. The position shall align with China's economic and social development needs and be one in urgent demand.
3. If laws or regulations specify other conditions for foreigners working in China, such provisions shall apply.
4. The applicant shall be legally employed and paid in Shanghai.
II. Legal Basis
Notice of the Shanghai Branch of the State Administration of Foreign Exchange on the Pilot Program for Facilitating Foreign Exchange Purchase and Payment for Foreign Talent Remuneration
III. Applicants
1. Employers based in Shanghai (The authorized representative recorded in the Service System for Foreigners Working in China must submit the paper documents at the service window).
2. Foreign individuals who are legally working in Shanghai and hold a valid Foreigner’s Work Permit in the People’s Republic of China and work-type residence permit.
IV. Application Procedure
(I) Application by Employers in Shanghai
The employer shall log in to the Shanghai Foreigner's Work in China Services System (https://kjgl.stcsm.sh.gov.cn/fwps/stcsm/login/loginX.jsp), enter the unified social credit code or organization code, company name, and mobile number for verification and login. After logging in, the authorized representative and mobile number shall be verified to enter the operation interface. Click "FAST PASS on Foreign Talent Remuneration Foreign Exchange (Application)" and enter the valid permit number held by the foreign individual for verification. Fill in the Special Information Form for Foreign Talent Remuneration Foreign Exchange, download and print the form (double-sided, single-page). The form shall be signed by the applicant and stamped with the company seal, then uploaded back to the system. There is no need to wait for a preliminary review result. The authorized representative or the foreign individual shall bring the original supporting documents to the corresponding acceptance authority for processing.
(II) Application by Foreign Individuals Working in Shanghai
The employer shall authorize the application. The authorized representative of the employer logs in to the Shanghai Foreigner's Work in China Services System (https://kjgl.stcsm.sh.gov.cn/fwps/stcsm/login/loginX.jsp), enters the unified social credit code or organization code, company name, and mobile number for verification and login. After logging in, the authorized representative and mobile number are verified to access the operation interface. Click "FAST PASS for Foreign –Talent Remuneration Foreign Exchange (Application)", enter the valid permit number held by the foreign individual for verification. After successful verification, click the authorization button to authorize the foreign individual to apply for the relevant service.
2. The foreign individual logs in to the Remuneration Foreign Exchange - Foreign Individual Access of the Shanghai Foreigner's Work in China Services System (https://kjgl.stcsm.sh.gov.cn/fwps/fwp/personally/toValid.do), enters the unified social credit code or organization code of the employer, company name, personal name, and permit number for verification and login. After logging in, click "Create New Remuneration Foreign Exchange Application", fill in the Special Information Form for Foreign Talent Remuneration Foreign Exchange, download and print the form (double-sided, single-page). The form shall be signed by the applicant and stamped with the company seal, then uploaded back to the system. There is no need to wait for a preliminary review result. The foreign individual shall bring the original supporting documents to the corresponding acceptance authority for processing.
V. Required Documents
(I) New Application with a Foreigner’s Work Permit in the People’s Republic of China
1. Special Information Form for Foreign Talent Remuneration Foreign Exchange.
2. Applicant's valid work-type residence permit: residence permit information page and entry stamp.
3. Other Documents: Additional documents as required by the acceptance authority based on specific needs.
(II) New Application with a Foreign Talent Visa (R Visa)
1. Passport information page and entry stamp page of the Foreign Talent "R" Visa.
2. Copy of the Confirmation Letter for Foreign High-End Talent.
3. Proof of income.
4. Special Information Form for Foreign Talent Remuneration Foreign Exchange.
5. Other Documents: Additional documents as required by the acceptance authority based on specific needs.
(III) Change (such as change of employer or change of remuneration)
1. Special Information Form for Foreign Talent Remuneration Foreign Exchange (old version).
2. Special Information Form for Foreign Talent Remuneration Foreign Exchange (new version).
3. Other Documents: Additional documents as required by the acceptance authority based on specific needs.
VI. Important Notes
1. Individuals shall properly keep the Special Information Form for Foreign Talent Remuneration Foreign Exchange and submit it to the handling bank each time when processing remuneration foreign exchange purchases.
2. Special Information Form for Foreign Talent Remuneration Foreign Exchange is valid for two years.
3. In case of expiration, changes, or balance transfer registration, the individual shall submit the original form to the acceptance authority for replacement. The remaining unpaid foreign exchange amount from the previous form shall be transferred to the new form.
4. The Special Information Form for Foreign Talent Remuneration Foreign Exchange contains important information and will not be reissued if lost. If the form is accidentally lost, the individual shall bring valid identification documents, labor contract, income certificate, and salary tax slip to the bank counter to handle the remuneration foreign exchange purchase.
5. The Special Information Form for Foreign Talent Remuneration Foreign Exchange must be printed double-sided.
