I. Target Applicants
(I) Basic Requirements for Employers
1. The employer must be legally established, have a physical business premise, pay taxes and social insurance in accordance with the law, and have no record of serious law violations or dishonesty. The position offered to the foreign national must be of special need, with no suitable local candidates available temporarily, and must comply with relevant national regulations. The wage and salary paid to the foreign employee must not be lower than the local minimum wage and salary standard.
2. If laws or regulations require prior approval by the competent industry authority, the employer shall obtain such approval.
(II) Basic Requirements for Applicants
1. The applicant shall be at least 18 years old, in good health and with no criminal record, have a confirmed employer in China, and possess the professional skills or corresponding level of knowledge required for their work.
2. The position shall align with China's economic and social development needs and be one in urgent demand.
3. If laws or regulations specify other conditions for foreigners working in China, such provisions shall apply.
4. Completion of Short-Term Work Assignments by Foreigners Entering China refers to foreigners entering China for the following purposes and staying for no more than 90 days:
(1) Carrying out technical, scientific research, management, guidance, or other work for a domestic partner;
(2) Participating in trial training at a domestic sports organization (including coaches and athletes);
(3) Filming movies (including commercials and documentaries);
(4) Fashion performances (including car model shows, print advertising shoots, and the like);
(5) Other circumstances recognized by the relevant authorities.
II. Legal Basis
1. Notice of the State Administration of Foreign Experts Affairs on Issuing the Service Guide for Foreigner Work Permit in China (Interim) (W. Z. F. [2017] No. 36).
2. Notice of the Ministry of Human Resources and Social Security, Ministry of Foreign Affairs, Ministry of Public Security, and Ministry of Culture on Issuing the Procedures for Handling the Completion of Short-Term Work Assignments by Foreigners Entering China (Trial) (R. S. B. [2014] No. 78).
III. Requirements for Submission of Documents
1. All original color paper documents and their Chinese translations must be uploaded electronically to the Service System for Foreigners Working in China.
2. Non-Chinese supporting documents shall be accompanied by Chinese translations, bearing the official seal of the employer (excluding passports or international travel documents).
IV. Required Documents
1. Application Form for the Foreigner’s Work Permit in the People’s Republic of China: To be completed and printed online. The applicant must sign the form (a copy or fax is acceptable), which must then be stamped with the employer's official seal or the seal of the authorized department within the employer's organization, and uploaded to the system.
2. Employment contract, project contract (cooperation agreement), or invitation letter/statement from the inviting entity.
3. Foreigner's passport or international travel document.
4. Complete Chinese and English resume of the foreigner (must include detailed personal information, education background, and work experience, stamped with the official seal of the employer).
5. Foreigners applying to undertake professional or technical work tasks shall, in accordance with national regulations, provide relevant academic or technical (occupational) qualification certificates (such as model cards, etc.).
6. Other supporting documents as required by the approval authority.
V. Important Notes
1. The contract term, working hours, and work location filled in shall be consistent with the actual work situation.
2. For short-term work involving dispatch, a tripartite agreement containing complete basic information of the dispatching party, the applicant, and the domestic employer shall be provided.
3. The contract shall cover the following aspects: the contract term shall not exceed 90 days, including 90 days; the number of work locations shall not exceed five (including Shanghai), with no duplication allowed, and the locations must be specified down to the city level; the work content must not exceed the business scope of the company; the average monthly salary of the short-term worker; insurance must be purchased before the short-term worker enters China; short-term workers are not allowed to engage in part-time jobs.
4. The employer and the foreigner shall ensure the authenticity of the commitments submitted and actively cooperate with verification work conducted by the approval authorities during interviews and regulatory inspections.
If false commitments are provided, the approval authority has the right to cancel the administrative decision in accordance with the law and suspend the employer, agency, and foreigner from applying for the Foreigner’s Work Permit in the People’s Republic of China. Violations of laws and regulations will be dealt with in accordance with the law.
