Application for the Foreigner’s Work Permit in the People’s Republic of China within Entrepreneurial Period by Foreign Talent and Team Members (Categories A and B)

I. Target Applicants

(I) Basic Requirements for Parks or Incubation Platforms

1. Parks or incubation platforms must be legally established, registered with and recommended by competent authorities at the district level or above. They must have an actual place of business, comply with tax and social insurance obligations, and have no record of serious legal violations or dishonesty.

2. "Parks" refer to various types of parks such as entrepreneurial, technological, industrial, or industrial development parks, which are recognized by the municipal-level competent authorities and have signed park agreements or lease contracts with entrepreneurial teams or individuals.

3. "Incubation platforms" refer to innovation-oriented incubators registered and subject to tax administration within each district, and which have signed incubation agreements and lease contracts with entrepreneurial teams or individuals. Incubation platforms may include nationally registered makerspaces, cooperative spaces for offshore innovation and entrepreneurship bases for overseas talent, national-level science and technology enterprise incubators, incubators affiliated with returnee entrepreneurship parks, as well as innovation-oriented incubators and functional platforms with international resources.

(II) Basic Requirements for Applicants

1. Foreign individuals and members of entrepreneurial teams (in principle, no more than five persons) who are in the startup phase, have not yet established a company, and are based in a recognized park or incubation platform.

2. The applicant shall be at least 18 years old, in good health and with no criminal record, and possess the professional skills or corresponding level of knowledge required for their work.

3. The position shall align with China's economic and social development needs and be one in urgent demand.

4. Support is given to international graduates who have obtained a bachelor's degree or above from universities in Shanghai, and outstanding foreign graduates with a bachelor's degree or above from high-level universities abroad (or in the Hong Kong, Macao, and Taiwan regions), to engage in innovation and entrepreneurship in the "Five New Towns" (Jiading, Qingpu, Songjiang, Fengxian, and Nanhui).

5. If laws or regulations specify other conditions for foreigners working in China, such provisions shall apply.

II. Required Documents

(I) Parks or Incubation Platforms

1. Business license or other valid registration documents.

2. Documents of recognition or recommendation issued by competent authorities at the district level or above.

3. Premises certification documents (e.g., property ownership certificate, lease agreement, etc.).

4. After the employer submits the organization information online, uploads all original documents, and completes the submission, there is no need to wait for a system response. The applicant shall bring the original organization registration information form along with all original and photocopied employer documents (stamped with the company seal) directly to the service window for real-name registration. The acceptance authority will not issue a separate notification once the review is approved.

(II) Overseas Application for the Foreigner’s Work Permit in the People’s Republic of China

1. Application Form for the Foreigner’s Work Permit in the People’s Republic of China.

2. Proof of work experience (Work duration is not restricted).

3. Highest academic degree (qualification) certificate and authentication documents.

For international graduates who obtained a bachelor's degree or above from universities in Shanghai and plan to start a business in the "Five New Towns" (Jiading, Qingpu, Songjiang, Fengxian, and Nanhui), the original academic qualification/degree certificate must be provided. Outstanding foreign graduates who obtained a bachelor's degree or above from high-level universities abroad (or in the Hong Kong, Macao, and Taiwan regions) shall meet the requirement of having graduated from a high-level university overseas (or in the Hong Kong, Macao, and Taiwan regions). The list of such universities shall refer to the rankings published in the Service System for Foreigners Working in China by the State Administration of Foreign Experts Affairs.

Outstanding foreign university graduates shall submit academic performance documents, demonstrating excellent academic results, with an average score of no less than 80 (on a 100-point scale, or converted from other grading systems), or B+/B and above (on a letter-grade scale).

4. Certificate of no criminal record and authentication documents.

5. Medical examination certificate.

6. Incubation agreement or site lease contract signed between the applicant and the park or incubation platform.

7. Applicant's passport or international travel document.

8. A recent front-facing, bareheaded photo taken within the past six months.

9. Supporting documents for accompanying family members.

10. Other Documents: Additional documents as required by the acceptance or decision-making authority based on specific needs.

(III) Domestic Application for the Foreigner’s Work Permit in the People’s Republic of China

1. Application Form for the Foreigner’s Work Permit in the People’s Republic of China

2. Proof of work experience (Work duration is not restricted).

3. Highest academic degree (qualification) certificate and authentication documents.

(IV) Extension of the Foreigner’s Work Permit in the People’s Republic of China

1. Application Form for Extension of the Foreigner’s Work Permit in the People’s Republic of China.

2. Incubation agreement or site lease contract signed between the applicant and the park or incubation platform.

3. Applicant's valid residence permit.

4. Other Documents: Commitment Letter for Full Online Processing of the Foreigner’s Work Permit in the People’s Republic of China (excluding Category A applicants); additional documents as required by the acceptance or decision-making authority based on specific needs.

(V) Cancellation of the Foreigner’s Work Permit in the People’s Republic of China

1. Application Form for Cancellation of the Foreigner’s Work Permit in the People’s Republic of China.

2. Proof of termination of the incubation agreement, site lease contract, or other documents related to the reason for cancellation. The termination of agreements or contracts must be signed by both parties.

3. Commitment Letter for Full Online Processing of the Foreigner’s Work Permit in the People’s Republic of China.

4. Other Documents: Additional documents as required by the acceptance or decision-making authority based on specific needs.

III. Verification Requirements

The Foreigner’s Work Permit in the People’s Republic of China is processed entirely online (Original application documents must be verified for new applications). Applicants shall bring all original documents upon entry into China. For overseas application: after obtaining the work permit and entering China, the applicant shall present the original documents to the accepting authority for verification within one month and before applying for the Residence Permit for Work. For domestic application: after passing the pre-review, the applicant shall bring the original documents to the accepting authority for verification.

IV. Important Notes

1. The maximum validity period of the Foreigner’s Work Permit in the People’s Republic of China for foreign entrepreneurial talent and team members is one year and shall not exceed the validity period of the signed incubation agreement, site lease contract (which must indicate that the premises are for non-temporary office use), the applicant's passport or other international travel documents, etc. Before the expiration of the Foreigner’s Work Permit in the People’s Republic of China, the park or incubation platform shall conduct an entrepreneurial assessment and apply for an extension or cancellation as needed.

2. The park or incubation platform shall complete the entrepreneurial assessment at least 30 days before the expiration of the Foreigner’s Work Permit in the People’s Republic of China and apply for an extension or cancellation as needed. If an extension is applied for again, the maximum validity period of the renewed Foreigner’s Work Permit in the People’s Republic of China shall not exceed one year.

3. All non-Chinese supporting documents must be accompanied by a Chinese translation stamped with the official seal of the park or incubation platform (except for passports or international travel documents).
